If you want the Director’s Selection, do nothing or mark SEND NOW and you’ll receive it automatically unless you decline it by the deadline date. To decline it or order another DVD, you may contact us via phone, reply on our website or return your Reply Card by the deadline date shown. You’ll always have 10 days to decide. If your catalog is delayed and you have less than 10 days to reply, you may return any unwanted Director’s Selection at our expense, and we’ll credit your account. A shipping and processing charge (and sales tax, if applicable) is added to each order. Shipping and processing charges cover all associated costs and services, including labor, materials, packing and postage. Heavy and/or bulky items may have additional charges. Payment Options
The credit/debit card or PayPal account you provide will be used for your introductory offer and for all future shipments and Club charges. We will automatically charge those items, including Director’s Selections, using the payment method you selected. If applicable, your card or PayPal account may be charged for any remaining DVDs required to complete your purchase commitment. You must keep a credit/debit card on file during your membership and you must keep us up-to-date with accurate member information, including your name, address, credit or debit card number and expiration date. You agree that we may update your information with information your bank or credit card issuer may supply.
Once you become a member, if you wish to change your credit/debit card, just contact Customer Service or visit the “Account” section of our website. To set up payment using a PayPal account, you must visit our website. You can also change or edit your payment method when placing an order or making a payment with your credit/debit card or PayPal account. We will continue to apply your payments under this payment method unless you notify us through Customer Service to change your billing preference. We accept payment by credit/debit card (i.e., American Express, VISA, Discover and MasterCard) or PayPal. Orders using a bank card will be processed as soon as bank authorization is received.
A valid credit/debit card or a PayPal account must be kept on file for all future shipments and Club charges. Once you are a member, you can use pre-paid/gift cards for one-time purchases.
If you have selected a credit or debit card as your payment method and the charge cannot be processed on that card (for example, the card has expired or we cannot obtain authorization from your card issuer), then for your convenience, we will attempt to charge any other credit or debit card that you have placed on file with us, in order to prevent disruption of your membership. When you update your payment method, any pending orders or charges, including Featured/Director's Selections, will be applied to the new payment method you provided. We are not responsible for any fees or charges that your bank, credit card or debit card issuer may apply. If your credit card issuer reverses a charge to your credit card, we may bill your account directly and seek payment by another method through a mailed statement.
We may report information about your account to credit bureaus. Information about your transactions with us, such as your account balances and payment history, may be reflected in your credit report.
Fulfilling your Membership Commitment
Fulfilling your membership commitment is as simple as purchasing the number of selections specified in your enrollment offer, at a purchase price of over $19.95 (see exclusions listed above), within the time period indicated in the offer. If after fulfilling your commitment you do not make a purchase within a six-month period, we may need to discontinue servicing your account.
If your account becomes overdue, or if you do not fulfill your membership commitment within the time period indicated in the offer, or if you cancel your membership before fulfilling your commitment, we will send you a reminder. If, thereafter, you do not fulfill your Membership Agreement, we will bill or charge you (depending upon your selected payment method) for the outstanding DVDs you agreed to buy. The commitment charge is calculated by taking the number of outstanding DVDs multiplied by the Club’s average DVD price (including shipping & processing), currently $25.25, subject to change, plus any applicable sales tax. When we communicate with you about fulfilling your Membership Agreement, we will include instructions on how to order your outstanding selections.
All selections purchased through your DVD Club are intended for personal use only and not for resale or any other commercial purpose. We reserve the right to cancel the account of any member suspected of violating this requirement and may limit the number of copies/titles that may be ordered on any account.
Hassle-Free Returns
To ensure that your account is properly credited, you must return any unwanted items in new, unopened and unused condition, at your expense, within 45 days of receiving the shipment. We reserve the right to refuse all other returns. If you have opened or removed the outer wrap or other seals from the enclosed selection, no refunds, adjustments or credits will be made unless the selection is defective or damaged. Please see your Welcome Guide or your Club website’s Help section for further information.
All claims for non-receipt of shipments must be made within 150 days from date of order. Replacement of and credits to your account for shipped merchandise claimed as not received may be subject to our investigation, which may include postal service notification. We will adjust your account at our discretion. Repeated claims of undelivered merchandise may result in our canceling your membership and billing you for any remaining purchase commitments you may have.
Marketing Preferences
We sometimes permit other companies to use our members’ names and mailing addresses to promote goods and services: Catalog, Publishing, Fundraising/Non-Profit, Financial, Credit Card, Insurance, Newsletters, other Club/Continuity programs, Education and Seminar companies, and other Direct Marketing service firms. Your Club will only use your email address to contact you about merchandise or product offerings that may be of interest to you, to contact you about your account, or for your Club’s internal use. We may share your information with other clubs or websites operated by our parent or affiliated companies. From time to time, your Club may arrange for other companies to provide you with joint products or services. Notice of Arbitration Agreement
Direct Brands, Inc. and you agree to ARBITRATE all disputes and claims between us arising out of or relating to this Agreement, as broadly interpreted to include any aspect of our relationship, including claims related to advertising. You thusGIVE UP YOUR RIGHT TO GO TO COURT, EXCEPT that YOU MAY bring an action against us in SMALL CLAIMS COURT. The arbitration will be under the prevailing Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes of the American Arbitration Association (the “AAA Rules”), as modified by this Agreement. The AAA Rules, including how to initiate a claim, are available online atwww.adr.org or by calling the AAA at 800-778-7879. If you choose arbitration, your rights will be determined by a neutral arbitrator and NOT a judge or jury. You are entitled to a FAIR HEARING, BUT arbitration procedures are SIMPLER AND MORE LIMITED THAN RULES APPLICABLE IN COURT. Arbitrator decisions are as enforceable as any court order and are subject to VERY LIMITED REVIEW BY A COURT.
Arbitrations will be conducted by one Arbitrator and will be Desk Arbitrations unless you or we request a Telephonic Hearing (as defined by AAA Rules). There will be no In-Person Hearing unless a claim seeks more than $75,000. We will pay all filing, administration, and arbitrator fees, unless the Arbitrator finds that your claim had no reasonable foundation or was brought for an improper purpose, in which case the Arbitrator must order you to pay those costs. After you notify us that you have commenced arbitration, we will promptly reimburse you the filing fee. If the Arbitrator issues an award in your favor on the merits of your claim that is greater than the value of our last written settlement offer made before the Arbitrator was selected, then the Arbitrator also may award you your reasonable attorney’s fees. We will not seek attorney’s fees from you even if we prevail. The Arbitrator will be bound by this Agreement.
The Arbitrator may award declaratory or injunctive relief only in favor of the party seeking relief and only as necessary to provide relief warranted by that party's individual claim. YOU AND DIRECT BRANDS, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Direct Brands, Inc. agree otherwise, the Arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Changes to Membership
We're always looking at ways to improve your membership experience. Accordingly, please note that Club services, promotions, policies, benefits, charges, programs, terms and conditions of membership are subject to change at any time. We will always notify you well in advance of any changes. By enrolling and continuing your membership, you accept and agree to the terms of this Membership Agreement and any changes made by us to it once we notify you of these changes. If you're not satisfied with the terms of the Membership Agreement or with the changes, you may cancel your membership without further obligation.
We reserve the right to request additional information, reject any application, or cancel any membership.
